Putting the “Personal” Back into Personal Injury Law

 Recently, I started writing a demand letter in a personal injury case involving physical injuries sustained in a motor vehicle crash.  On its surface, this did not appear to be a big case.  Liability was not an issue, just damages.  As I usually do when writing a demand letter, I go through all of the facts and all of the medical records and write a detailed narrative of what happened and why my client is entitled to compensation.  As I was going through the medical records line by line, it struck me that this was not as simple a case as it appeared to be.  From a superficial point of view, this appeared to be a case with soft tissue injuries taking several months to resolve with pain medications and physical therapy.  End of story.  But on closer examination, there was a lot more going on.  First, x-rays revealed a permanent injury. Not a big one but permanent nevertheless.  Second, my client had a job which over time could result in an aggravation of this injury.  Third, my client was fairly young meaning that he was going to have this injury for a long period of time.  So, what looked like a fairly straight forward case from a distance was not that straight forward at all.  This is called putting the "personal" back in personal injury law.  In other words, we recognize that no two cases are alike and that each case cannot be settled or taken to trial until each and every injury and other element of damages has been fully accounted for.   If you want to make sure that your personal injury case is handled in the same way and that you get all of the compensation to which you are entitled, please give us  a call at  401-714-0622 or you can reach me on my cell phone at 401-714-1391. We would be happy to discuss your case with you and, remember, all initial consultations are free and if we do not win your case at trial, you owe us nothing.
